Acceptable Use Policy

Preamble

The Acceptable Use Policy exists for the purpose of legalities, to ensure users and user agents, obey copyright and other legal requirements of the Anthonyparsons.com Directory (APD).

Definitions

IAW: In Accordance With

User: A user in computing context is one who uses a computer system to browse APD.

UserAgent: Web user agents range from web browsers to search engine crawlers ("spiders"), as well as screen readers and braille browsers used by people with disabilities.

Policy

Anthony Parsons grants you access to the APD at his sole right, free of charge. By using the APD, you agree to be bound by the following "use" policy applicable to the APD exclusively. If you do not agree to these terms and conditions, then do not use or submit to APD.

You understand that you have no rights to the services except as indicated in this acceptable use policy.

Acceptable Use

The APD is intended solely for your personal, non-commercial use only. You may not copy the content contained within the APD for use on your own site, media, advertisement, copy, distribution or other platform without prior permission from Anthony Parsons, this includes user agents; other than for the purpose of search engine results. If you desire to use the content contained herein, whether personal or commercial use, you must enter into an agreement with anthonyparsons.com for these rights. Such commercial or personal use must be performed in advance.

Unacceptable Use

The APD have measures in place to combat unacceptable use of the content contained within. Primarily, user agents are the offender to acceptable use, thus are clearly indicated within this policy for legal purposes. The illegal copy, crawl, spidering, scrape or cloaking of user agents as browsers to copy content in whole or part, is strictly forbidden IAW this and all the APD policy.

Violations

You can report violations of this policy to Anthony Parsons through any contact form from within the network. Violations of this policy will be actioned through our legal department (contracted) to deal swiftly with these matters.

Advertisement Information

The Anthonyparsons.com Directory (APD) allocates a limited number of positions for site wide advertisement only. These positions are given to those who we deem provide a product, service or informational website of value to our users.

Listing Details

Title: May contain a two or three keyword phrase, descriptive of the site / page pointed towards.
Description: Approximately 10 words describing the product, service or information.

How Many Advertisers Allowed

The limit is ten (10) advertisers, and once reached, no further advertisements will be accepted until a current advertiser ceases being such an advertiser upon the directory.

Placement of Advertisement

As we are proud to display the websites we allow as advertisers, they are prominently displayed down the left hand side of every page across the directory, including secure https pages.

How Much Does it Cost?

The current cost is US$100 per month, automatically recurring to debit your account on the anniversary of initial payment.

Is Every Website Accepted Through The Normal Submission Process Automatically Approved?

No. Who we allow within the general directory results in one thing, but who we prominently display as our advertiser is another. Advertisers must apply uniquely from the general submission process for site wide advertisement, as we are only after displaying sites with absolute quality products, service or information, that we believe could be of beneficial use to our users.

How Do I Become an Advertiser?

You must apply from our advertisement section, at which point your request will be reviewed and accepted or rejected. If accepted, your email will contain the payment URL where you may make payment through Paypal on a monthly subscription basis, automatically recurring.

Can I Cancel at Anytime?

Yes. To cancel your site wide advertisement subscription, you simply need to login to your Paypal account, find the subscription payment and cancel it. We will be sent a confirmation of cancellation, at which point your advertisement will be removed from listing on the next anniversary for payment.

Editorial Review Process

The Editorial Review Process (ERP) outlines how your site is managed by the Anthonyparsons.com editorial team, once submitted. The review process is as follows, in order:

  • Customer submits site for review.
  • Submission queues for editor review, and is prioritised as follows:
    • Sponsored submissions reviewed first.
    • Express submissions reviewed after.
    • Modified submissions are reviewed only when time permits, as they have already been approved and are live to users.
  • Editor reviews submission within 5 business working days (excludes weekends, public holidays and APN holiday periods)
  • Editor reviews the following within each submission (more detail in SG):
    • Site content, quality and uniqueness.
    • Cross browser friendliness.
    • User navigability.
    • Inappropriate techniques.
  • If rejected, all submission types receive notification via email to the address provided. Paid submission refunds are applicable as follows:
    • US$10 Express Service: Nil refund.
    • US$30 Sponsored Service: Refund minus US$10 express service fee.
  • If accepted, monies cease being refundable, or containing any refundable component.
  • Editor will review category selection and change as applicable, regardless of submission type.
  • Editor will review submitted details and change as applicable to suit each submission type as follows:
    • Express Submission: Title will be changed to reflect the name of the business / website. Description will be changed to reflect an accurate description of website information, without marketing hype. URL will be amended to point at the root domain.
    • Sponsored Submission: Title may be amended if spammy. Description will be changed to reflect an accurate description of website information, without marketing hype. The URL will remain as submitted providing it is appropriate and pointed towards a relevant content page.
  • Submission goes live.
  • Customer notified that submission is now live, and its location.

Note: Whilst we will endeavour to please our customers, the editors decision is final, and dictation to the editor will not be tolerated. Such acts may warrant removal of your submission and loss of monies for services performed. Paypal does not provide chargebacks for the sale of services as per Paypals terms and conditions.

Frequently Asked Questions

What Type of Submissions Do You Provide?

We provide two distinctive submission types, they are as follows:

Express Service is reviewed within 5 business working days, excluding weekends, public holidays and APN holidays. Express submission is listed as with no precedence, alphabetically sorted, below sponsored submissions. Express submissions are linked to the homepage only. Payment of express submission does not guarantee inclusion.

Sponsored Service is reviewed within 5 business working days, excluding weekends, public holidays and APN holidays. Sponsored submission is listed above express submits, alphabetically sorted. Sponsored submissions can be linked to any page of the website using keyword anchor text within reasonable limits.

If I Recommend a New Category, Will It Be Opened?

No. Quite often people are lazy to look for the correct category, so they simply submit for a new one. We review each request on it's individual merits. If the listing deserves a new category, then one will definitely be opened for it.

Do You Give Discounts For Bulk Submissions?

Yes. You must be prepared to submit in batches of 10 as a minimum. Bulk submissions will save 10% of the overall cost. Please use the contact form to discuss this. We will then ask you to email all the details to us, and provide you a separate payment option.

What If I Want To Sponsor Multiple Categories?

We only allow bulk submit clients the ability to sponsor multiple categories. Please use the contact form to discuss.

Payment Failed, Now It Won't Let Me Submit?

When you submit your site and either payment fails or you change your mind to modify your listing, your listing is already temporarily entered into our system awaiting payment. Cron automatically cleans the system of non-paid listings daily. Simply wait 24 hours and resubmit.

I Want To Sponsor a Category That Needs to be Created

Categories are only created through suggestion if applicable, or an editor will create one as the submission does not appropriately fit existing categories.

Privacy Policy

Anthonyparsons.com Directory (APD) as part of the anthonyparsons.com network, respects and protects your privacy, when you are using the APD website infrastructure. Information that may specifically identify you as an individual is not collected by APD staff, nor shared with third parties.

What Information Do We Collect?

APD does not collect information about you (such as your name, email address, etc.) except when you specifically and knowingly provide such information during the site submission process. This information is used to contact you for acceptance / rejection purposes only. APD only collects basic web statistical information such as time of day, browser type, browser language, site search data and IP address with each query. This information is for APD use and statistical purposes only.

Your consent and changes to the Privacy Policy

By using the APD, you consent to the collection and use of your information as outlined in this policy. The APD may decide to change this Policy from time to time without notice. The purpose of this Policy is to provide you of what information is collected and the uses for complied information.

Payment Gateway

Paypal does not provide users secure credit or payment information. Paypal provide us basic information as per you outline during the submission process, such as your name, your Paypal email address (if applicable) and the amount of funds processed. Paypal provide their own privacy policy, in which you must read in conjunction with this policy.

Use of Self Expressed Submission Data

The data you submit willingly when submitting to APD is accessed only by APN editors. No other person, has general access to this information, including names, email, IP, etc. The anthonyparsons.com network DOES NOT use email marketing or related services. The only correspondence a customer will receive from the anthonyparsons.com network, is an acceptance / rejection notification, payment refund notifications and correspondence that is only ever initiated by the customer themselves. Your information is securely stored behind 256bit data encryption for privacy concerns.

Submission Guidelines

In conjunction with our editorial review process, these guidelines outline what a submission must comply with in order to be accepted into Anthonyparsons.com Directory (APD).

Sites To Include

Sites than contain unique, original content / products, points of view on topical discussion or informational value to the user.

Editors consider the following points within this process:

  • Is the content unique? Copyscape random URL checks performed.
  • The site must not contain what APD have deemed, "sites not to include."
  • The site must be complete, with no under construction or partial pages.
  • Is the site current? For example; a gift basket site may not change for years, though a news site must be constantly updated.
  • The site must load timely and completely, without error to site across multiple browsers
  • Inclusion is an editor's discretion. Commonsense prevails within the review process.

Sites Not To Include

Sites that do not comply with the above standards, will not be accepted into APD. Such instances include, but not limited too:

  • Non-English Versions

    Websites in any language other than English, or without a full English version, are not acceptable within APD. We don't have anything against sites in other languages, its more a user focal point, that most of our market is English speaking targeted.

  • Affiliate Marketing Schemes

    Affiliate sites are classed as any website that participates primarily in revenue sharing between advertisers, merchants, publishers or salespeople, typically ending in an agent/referral fee/sales channel concept. There are four basic types of affiliate sites, being affiliate links, sites consisting primarily affiliate links, affiliate reseller sites and Multi-Level Marketing (MLM).

    Affiliate Links - whilst by themselves used sparingly within a site is acceptable, listing an actual affiliate URL within any submission is not acceptable.

    Affiliate Sites - whilst the affiliate concept is acceptable to APD, the listing of such sites are not, because the sites themselves generally contain very little unique content, thus making the content association of the site a reproductive association too many websites across the Internet. Sites such as Amazon product resellers, CD and DVD stores that don't actually provide the good themself, and so forth, are not acceptable within APD.

    Affiliate Reseller - these sites whilst harder to spot can be identified with a closer look, generally resembling resellers or lead generation type sites. A brokerage site could be classed very close to this type of classification, though the difference lay between the work performed, ie. a broker must perform work to sell the product/service to gain commission, where a lead generation site does not perform any work, as they are merely a 'middle man' so to speak.

    Multi-Level Marketing - such sites would include companies such at Tupperware, Amway, Herbalife and so forth. Whilst listing the actual company themselves is acceptable (Amway Company Website, Tupperware Company Website), some of these MLM companies do not allow resellers to market individually, thus by listing any such site, APD would be breaching those companies constitutes, ie. Amway and Tupperware. Herbalife company domain would be acceptable for advertisement, however; Herbalife themselves allow their resellers to market individually, thus these type of reseller sites are not acceptable within APD listings.

  • Mirror Sites

    Mirror sites are those that replicate complete content, with little to no change. Many sites change layout, though contain the same content to the master source reference. If you provide a website that contains mirror websites, and it is not the actual original of the content source, then your site is not acceptable for listing. A good example of this is DMOZ, where people will use DMOZ XML results to create a directory (an exact replica), though give it another name and generally place contextual advertising across every page. We utilise copywriting programs to check for mirrored content.

  • Redirects and "Cloaked" URLs

    A redirected site is one that when clicked upon the source URL, displays a different URL. These type of sites are often made for deceptive search engine tactics, and not acceptable within the APD listings. Redirects are often used to submit a site multiple times under different domains.

    Cloaked URL's are often similar, where a site URL is different to the source of the content being shown, ie. content is framed within the page. Real Estate websites often fall into this category with MLS listings. The Real Estate URL is displayed, though the majority of the content is fed from another URL (MLS site), which is determined as URL cloaking for the purposes of APD listings.

  • Illegal Sites

    Sites with unlawful content are not acceptable for legal reasons, which could be brought upon APD. Such sites that promote illegal activity could be hatred; violence; online gambling (which are near illegal now across the globe); abortion sites that may list doctors names, addresses and next of kin details (though an abortion site that only lists doctors names may be acceptable); music and movie free sharing sites, and so forth. These types of sites bring unnecessary public opinion towards APD, which is not within the best interest of its customers.

  • Site Listings Including Search Results

    Site listings should take a user to a specific URL. These URL's, and internal URL's, must not merely contain search results from the listed site, or other external site.

  • Distribution Listings

    Sites that contain a singular product will be approached carefully, as in general a circumstance, the site in question is either an affiliate or custom domain to market individual products. These types of domains provide no original content to the user, as they generally redirect to another domain for purchase. These type domains are not acceptable within the APD listings.

At the time of site submission, every effort has been made to eliminate sites that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a search will not display unintended or objectionable content and assume no responsibility for the content of any site included in any search results or otherwise linked to by the APD site. Given the enormous volume of web site information added, deleted, and changed on a frequent basis, APD cannot and does not monitor everything made available through its indices on a daily bases.

APD disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the anthonyparsons.com network or APD website. You further understand the use APD is solely at your own risk.

Intellectual Property Policy

It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act in an appropriate manner under such Act and other applicable intellectual property laws, including the removal or disabling of access to material claimed to be the subject of infringing activity.

Without limiting the foregoing, under no circumstances shall APD, or any member of the anthonyparsons.com network be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Requests for Removal of Links

APD consists of information that has been identified, reviewed, indexed and compiled by human beings. APD occasionally receives requests from people to remove links from its directory. Although APD reserves the right to address such requests individually, the general principles for such actions are:

APD would consider on a case-by-case basis requests to remove the link to a site from its platform. For each web site reflected in APD, anthonyparsons.com network may remove links if either:

a. a site owner restricts access to his or her web site,
b. a site is taken down from the web,
c. a site is placed in an inappropriate category, and
d. a site's content has changed significantly

Contact should be made with anthonyparsons.com network to submit a request for a site link removal. Anthonyparsons.com network reserves the right to remove links or to take action on your request.

Miscellaneous Provisions

This Terms of Service are governed by and construed in accordance with the laws of the State of Victoria, Australia, without giving effect to its conflict of laws are provisions to your actual State or Country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of this Terms of Service of Use to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service constitutes the entire agreement between the parties and anthonyparsons.com network with respect to the subject matter hereof and any future changes made by anthonyparsons.com network to these terms of service supersedes and replaces all prior or contemporaneous understandings of our Terms of Service, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by Anthony Parsons.

We may modify or terminate our platform from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time without notice. Please review these Terms of Service from time to time so that you will be apprised of any changes.

If you do not read and obey these guidelines strictly, then you have no recourse for further action to us or any credit gateway that anthonyparsons.com network utilises.
